California push to change candidate residency laws scrapped

Legislators have given a boost last-minute changes to state election laws amid criticism that the changes could undermine the new state primary system and give more leeway elected in the residence stating that they jockey for newly established districts.

Assembly Bill 1413, by Paul Fong assemblyman, D-Cupertino, included a provision stating that the residence of a member of the Legislature or Congress "shall be conclusively presumed to be the address of that person is now filed an affidavit of registration."

The proposal came as a handful of legislators are faced with the prospect of moving to qualify to run under the new state political maps. The schedule has also raised eyebrows in light of impeachment last year by Senator Rod Wright, D-Los Angeles, who face charges stemming from accusations he lied about his residence for a period of the state legislature.

Fong, who chairs the Assembly elections and redistricting committee said earlier today that the project would not impact the case of Wright, but was intended to "clarify the rules of residence" for members before the 2012 elections.

"There's a lot of moving going on right now and so we just wanted to clearly define the residency... to be the domicile," he said.

But at least one good-government watchdog denounced the bill as an example of "end-of-the-year cloak and dagger tactics to make substantial changes to state law without proper public deliberation and input."

"We were told by Capitol staff that AB 1413's amendments were simple clean-up language and make only technical changes as a result of judicial decisions. However the contrary seems to be apparent," Phillip Ung, policy advocate for Common Cause California, said in a statement.

The bill also called for changing "party preference" language that will be used to identify candidates under the new top-two primary system to party "affiliation," a move that came under fire from sponsors of the 2010 ballot measure creating the new voting process.

13200.(A) not earlier than six months after the death of a deceased person or his beneficiaries as the successor of the deceased to a particular piece of property is real property may file with the County Superior Court in which the deceased was domiciled at the time of death, or if the deceased was not domiciled in this state at the time of death, then in a county in which real estate of the deceased is located, an affidavit in the prescribed form by the Judicial Council pursuant to section 1001 specifying all of the following: (1) The name of the deceased. (2) The date and place of death of the deceased.(3) A legal description of property and interest of the deceased therein. (4) The name and address of each person serving as guardian or conservator of the estate of the deceased on the death of the deceased, the currently known to the author of the affidavit. (5) "The gross value of all property in the deceased's estate located in California, as shown in the inventory and assessment attached to this affidavit, other than real property described in Section 13050 of the Code approval in California, does not exceed 20,000 dollars (20,000 USD)."(6)" At least six months have passed since the death of the deceased as indicated in a certified copy of death certificate of the deceased attached to this affidavit.
